📄 1. Acceptance of Terms

By accessing or using PharmaWise ("the Service") at pharmawise.health or any related domain, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users of PharmaWise, including patients and pharmacy partners.

💊 2. What PharmaWise Is (and Is Not)

PharmaWise is a medication education platform. It helps patients understand their medications through plain-language explanations sourced from official FDA drug labels and AI-assisted summaries.

PharmaWise is not:

• A licensed pharmacy or dispensing service
• A medical device or FDA-regulated software
• A replacement for your pharmacist, doctor, or healthcare provider
• A source of individualized medical advice or diagnosis

👤 3. Eligibility

You must be at least 13 years old to use PharmaWise. By using the Service, you represent that you meet this requirement.

If you are using PharmaWise on behalf of a minor as a caretaker or delegate, you accept these Terms on their behalf and are responsible for their use of the Service.

🔑 4. Your Account

To access personalized features (medication history, reminders, refill tracking), you must create an account using a verified email address or phone number.

• You are responsible for maintaining the confidentiality of your account.
• You agree to notify us immediately at support@pharmawise.health if you suspect unauthorized access.
• You may not share your account credentials with others. Use the delegate access feature instead.
• We reserve the right to suspend or terminate accounts that violate these Terms.

✅ 5. Acceptable Use

You agree to use PharmaWise only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to reverse-engineer, scrape, or copy any part of the Service
• Upload malicious content or attempt to disrupt the platform
• Use the Service to provide medical advice to others as if you were a licensed professional
• Misrepresent your identity or create fraudulent accounts
• Access another user's account without their explicit authorization
• Use the platform in any way that violates applicable laws or regulations

⚕️ 6. Health & Medical Disclaimer

The information provided by PharmaWise is for educational purposes only. It is derived from publicly available FDA drug label data and is intended to help patients understand their medications in plain language.

This information:

• Does not constitute medical advice
• Does not account for your complete medical history, other medications, or individual health conditions
• Should not be used to start, stop, or change any medication without consulting a licensed healthcare provider

Always consult your pharmacist or physician before making any decisions about your medications. In an emergency, call 911 or your local emergency services.

🤖 7. AI-Generated Content

PharmaWise uses proprietary AI to generate plain-language medication summaries. While we strive for accuracy, AI-generated content may occasionally contain errors or omissions.

• AI summaries are based on official FDA labels, but may not reflect the most recent label updates.
• AI content is not reviewed by a licensed pharmacist before display.
• You should confirm critical dosing or safety information with your pharmacist.

By using the AI features, you acknowledge these limitations and agree not to rely solely on AI-generated content for medical decisions.

The PharmaWise platform, including its design, branding, code, and original content, is owned by Dibiax Health Technologies and protected by applicable intellectual property laws.

FDA drug label data is in the public domain. AI-generated summaries are provided for your personal, non-commercial use only.

You may not reproduce, distribute, or create derivative works from any part of PharmaWise without prior written permission.

🏪 9. Pharmacy Partners

PharmaWise is offered to patients through participating pharmacy partners. If you access PharmaWise via a pharmacy QR code or link:

• Your pharmacy has agreed to PharmaWise's partner terms, including a Business Associate Agreement (BAA) where required by HIPAA.
• PharmaWise does not act as an agent of your pharmacy and is not responsible for your pharmacy's services.
• Pharmacy partners may see aggregated, de-identified usage analytics.

💳 10. Payments & Subscriptions

PharmaWise is free for patients. Pharmacy partners may subscribe to a paid plan to offer PharmaWise to their patients.

• Payments are processed securely by Stripe. PharmaWise does not store payment card details.
• Subscription fees are billed as agreed upon signup.
• Refunds are handled on a case-by-case basis. Contact support@pharmawise.health for billing inquiries.
• We reserve the right to change pricing with reasonable advance notice to pharmacy partners.

🚫 11. Termination

You may delete your account at any time from your profile settings or by contacting us at support@pharmawise.health.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including the health disclaimer, limitation of liability, and governing law) will survive.

⚖️ 12. Limitation of Liability

To the maximum extent permitted by law, PharmaWise and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

PharmaWise's total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to PharmaWise in the twelve months preceding the claim (or $50 if you have not paid anything).

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or accuracy of health information.

🏛️ 13. Governing Law

These Terms are governed by the laws of the United States and the state in which PharmaWise is incorporated, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable under law.

📝 14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email.

Your continued use of PharmaWise after updated Terms are posted constitutes your acceptance of the revised Terms.
